Introduction
1.1 These Terms of Service ("Terms") govern access to and use of the website www.oculta.app and the Oculta App application, together, the "Service".
1.2 The Service is operated by: FLOWER EXECUTION LIMITED, Flat A 15/F Hiller Commercial Building, 65-67 Bonham Strand East, Sheung Wan, Hong Kong.
1.3 By accessing, downloading, registering for, or using the Service, you agree to be legally bound by these Terms.
1.4 If you do not agree with these Terms, you must not access or use the Service.
1.5 Use of the Service may also be subject to our Privacy Policy, which describes how we collect, use, and protect your information.
Description of the Service
2.1 Oculta App is a digital tool designed to help users view and read content discreetly during video calls, presentations, or recordings.
2.2 The application allows text to be displayed on screen through an interface designed not to appear in recordings or screen sharing.
2.3 The Service may evolve over time. We reserve the right to modify, update, or remove Service features at any time in order to improve the user experience or comply with technical or legal requirements.
Usage Requirements
3.1 To use the Service, you must be at least 16 years old or the minimum legal age applicable in your jurisdiction.
3.2 By using the Service, you confirm that:
3.2.1 you have the legal capacity to accept these Terms
3.2.2 all information you provide is truthful and up to date
3.2.3 you will use the Service in accordance with applicable law
3.3 We reserve the right to limit or deny access to the Service if we reasonably believe these requirements have been breached.
User Account
4.1 Some Service features may require the creation of an account.
4.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
4.3 You must notify us immediately if you detect any unauthorized use of your account or any security incident.
4.4 We reserve the right to suspend or terminate accounts that breach these Terms, show suspicious activity, or pose a risk to the operation of the Service.
Subscriptions and Payments
5.1 Some Service features may require a paid subscription.
5.2 Subscriptions may be managed through third-party providers such as the Apple App Store through its in-app purchase system.
5.3 If you subscribe through the Apple App Store:
5.3.1 payments will be processed directly by Apple
5.3.2 subscriptions may renew automatically according to Apple’s terms
5.3.3 subscription management, modification, or cancellation must be carried out from your Apple account
5.4 Subscription prices may change occasionally. Any price change will apply only to future subscription periods.
5.5 Refunds
If a subscription or purchase of the Service is made through third-party platforms, such as the Apple App Store, payments will be processed directly by those providers.
Any refund request must be handled directly with the corresponding platform and will be subject to its refund policies and terms of service.
Oculta does not process or manage refunds for purchases made through third-party platforms.
To the extent permitted by applicable law, subscriptions are non-refundable once the billing period has started.
Permitted Use of the Service
6.1 The Service must be used only for lawful purposes and in accordance with these Terms.
6.2 You agree not to:
6.2.1 use the Service for illegal or fraudulent activities
6.2.2 interfere with the operation of the Service
6.2.3 attempt to gain unauthorized access to systems, servers, or accounts
6.2.4 copy, reproduce, redistribute, or commercially exploit the Service without authorization
6.2.5 use the Service to violate third-party rights
6.3 We reserve the right to suspend or terminate access to the Service in the event of misuse.
User Content
7.1 Content entered by users into the application is the sole responsibility of the user.
7.2 Oculta App does not actively review or monitor content entered by users.
7.3 By using the Service, you represent that the content you use:
7.3.1 does not infringe intellectual property rights
7.3.2 does not violate applicable law
7.3.3 does not violate third-party rights
Intellectual Property
8.1 The Service, including the software, design, interface, features, logos, and trademarks, is owned by FLOWER EXECUTION LIMITED or its licensors.
8.2 These elements are protected by intellectual property laws and other applicable regulations.
8.3 Unless expressly authorized, it is not permitted to copy, modify, distribute, reproduce, or create derivative works from the Service.
Availability of the Service
9.1 We strive to keep the Service available and functional.
9.2 However, we do not guarantee that the Service will be available without interruption or free from errors.
9.3 The Service may be temporarily suspended for maintenance, updates, or circumstances beyond our control.
Disclaimer of Warranties
10.1 The Service is provided "as is" and "as available".
10.2 To the extent permitted by law, we do not guarantee that:
10.2.1 the Service will be free from errors
10.2.2 the Service will be available without interruptions
10.2.3 the Service will meet users’ specific needs
Limitation of Liability
11.1 To the maximum extent permitted by law, FLOWER EXECUTION LIMITED shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Service.
11.2 This includes, among others, loss of data, loss of profits, or interruption of activities.
11.3 Nothing in these Terms limits liabilities that cannot be legally excluded.
Termination
12.1 We may suspend or terminate your access to the Service if:
12.1.1 you breach these Terms
12.1.2 you use the Service fraudulently or abusively
12.1.3 there is a risk to the security of the Service
12.2 You may stop using the Service at any time.
12.3 After termination, the provisions relating to intellectual property, limitation of liability, and applicable law will remain in effect.
Privacy
13.1 The processing of personal data related to the use of the Service is governed by our Privacy Policy.
13.2 You can view the Privacy Policy at: www.oculta.app/privacy.
Changes to the Terms
14.1 We may update these Terms occasionally to reflect changes to the Service, legal requirements, or operational improvements.
14.2 When relevant changes occur, we will publish the updated version on the website and indicate the update date.
14.3 Continued use of the Service after changes have been published constitutes acceptance of the new Terms.
Applicable Law
15.1 These Terms shall be governed by and interpreted in accordance with the laws of Hong Kong.
15.2 This does not affect any consumer rights that may apply under the laws of your place of residence.
